FUNCTIONS

RECONSTITUTION OF THE DSWD COMMITTEE ON ANTI-RED TAPE (CART) AND ANTI-RED TAPE UNIT (ARTU)

In the exigency of service and the need for continuing compliance with the requirements of the Republic Act No. 11032 (EODB Law), Anti-Red Tape Authority (ARTA) Memorandum Circular No. 2020-07, and other related issuances as well as the harmonization, streamlining and integration of related functions, the DSWD Committee on Anti-Red Tape (CART) and Anti-Red Tape Units (ARTU)  are hereby reorganized and reconstituted.

The CART structure is further enhanced to incorporate the functions of the DSWD National Total Quality Management Steering Committee and the Quality Management Program - Program Management Team (QMP-PMT) as champions of the principles of Total Quality Management (TQM) and lead in the provision of directions and guidance in the enhancement and implementation of the DSWD Quality Management Program (QMP) geared towards full compliance with the EODB Law and other relevant statutory and regulatory requirements. 

The DSWD ARTU, on the other hand,  shall take on the roles, duties, and responsibilities of the OBS’ Quality Management Team (QMT), while the Cluster Management Committees shall assume the roles, duties, and responsibilities of the Cluster QMT.

Moreover, the ISO/QMS Committees will be reorganized as CART Technical Working Groups to perform their duties and responsibilities along TQM which would include the EODB and QMS

DSWD CART Primary Duties and Responsibilities

The DSWD CART shall ensure that the Department fully complies with the requirements of EODB Law, its IRR, and subsequent issuances by the ARTA, as may be applicable, utilizing various national and international management systems and standards such as the ISO 9001 for Quality Management Systems (QMS), other ISO standards, and the Performance Excellence Framework of the Philippine Quality Awards, among others. 

Specifically, the requirements indicated above pertain to the conduct of the following: 

1. Develop, formulate, and implement policies and mechanisms that will ensure full compliance of the Department with the EODB Law and other relevant statutory and regulatory requirements;

2. Ensure that the policies and mechanisms established are consistent with the principles of the Whole of Government and the Whole of Nation Approach that will result in a more harmonized inter-agency/partners collaboration and support through streamlined systems and interoperability procedures towards an improved program and service delivery;

3. Review and develop strategies and timelines related to the Department-wide implementation of the QMP/QMS, and conduct enhancements/recalibrations, if needed;

4. Review and implement improvements on the QMS, aligned with the EODB Law and other relevant statutory and regulatory requirements;

5. Review and register of Standard Operating Procedures (SOPs) of the Department as required under the DSWD QMS;

6. Develop and institutionalize the Manual of Operations of CART as well as its attendant SOPs to effectively operationalize its functions and responsibilities;

7. Create and/or improve appropriate Technical Working Group (TWG) to address various requirements of CART in the performance of its functions;

8. Conduct Public Consultation and vetting process on the SOPs with process implementers;

9. Conduct Standardization, Streamlining, and Reengineering, and propose digital initiatives/automation and continual improvement to services and support functions;

10. Deliberate and approve the Program and Service Delivery Improvement Plan of OBS/FOs as recommended by the CART Secretariat; 

11. Ensure effective implementation of the Program and Service Delivery Improvement Plan (PSDIP) within the set timeline;

12. Conduct compliance cost and benefit analysis, time and motion studies, evaluation and monitoring of improvement of all the agency's services and support functions, and reengineering of the same;

13. Subject to the Guidelines/National Policy on Regulatory Management System to be issued by the ARTA:

    • Establish the DSWD Regulatory Management System and Standards;

    • Notify the ARTA of every formulation, modification, and repeal of regulations, ordinances, or other related issuances;

    • Conduct post-implementation assessment and review of existing regulations, ordinances, or other related issuances, and undertake Regulatory Impact Assessment (RIA);

    • Prepare a Preliminary Impact Assessment (PIA) whenever there is an intent to formulate, modify, or repeal a regulation and submit it to the ARTA;

    • Produce a Regulatory Impact Statement (RIS) upon completion of each RIA and submit it to the ARTA for review and assessment;

    • Refer to the ARTA’s policy option or recommendations to the appropriate decision-makers within the agency;  and

    • Submit  an inventory and electronic copies of all existing (both in effect and repealed) regulations and issuances to populate the Philippine Business Regulation Information System (PBRIS) of ARTA.

    • Register new regulations and issuances to the UP Office of National Administrative Register and Official Gazette for publication within fifteen (15) days from issuance.

14. Ensure effective knowledge transfer, or information dissemination among offices and employees on ARTA-related training, briefings, or such related matters obtained by office staff within sixty (60) days from the end of the training;

15. Spearhead the implementation of Citizen’s Charter

• Set up the most current and updated service standards and indicate in the Citizen's Charter in accordance with the prescribed template issued by the ARTA, and submit the same to the ARTA to populate the Anti-Red Tape Electronic Management Information System (ARTEMIS);

• Monitor and periodically review the office or agency's Citizen's Charter, specifically: procedures/steps, time, documentary requirements, and fees;

• Lead in the enhancement/updating of DSWD Citizen's Charter, should there be any change/s, it must be posted earlier than March 31st of each year;

16. Promote agency compliance with the zero-contact policy in accordance with the EODB Law through the establishment of appropriate policies and mechanisms as well as corresponding monitoring of its effectiveness;

17. Monitor the provision of automatic approval and/or automatic extension of license, clearance, permit, certification, authorization, and services beyond the prescribed processing time of 3-7-20 working days while ensuring proper implementation of the Zero Backlog Program;

18. Lead in the continuous improvement of the agency's external and internal services including its support functions while ensuring compliance with the prescribed processing time as mandated by EODB Law or the agency's mandate under special law;

19. Establish and manage a public assistance complaints desk or ARTA Helpdesk to effectively receive complaints, and feedback, and monitor customer satisfaction via hotline numbers, short message service (SMS), information and communication technology, or other mechanisms where clients may adequately express their complaints, comments, or suggestions. The CART must ensure that complaints forwarded by the Presidential Complaints Center, Civil Service Commission's Contact Center ng Bayan, and Complaints Action Center of the ARTA are acknowledged, received, responded to, and/or acted upon within the prescribed period by the intended recipient within the DSWD;

20. Establish appropriate client feedback mechanism and client satisfaction measurement;

21. Submit a report to the ARTA not later than the last working day of January of each year the results of the Client Satisfaction Survey for each service based on the guidelines to be issued by the ARTA;

22. Serve as the arbiter for Ease of Doing Business complaints and grievances;  

23. Coordinate with the agency's communications/public relations office the dissemination of ARTA Information, Education, and Communication materials for public consumption through Communications, research, and campaigns TWG;

24. Provide advice/recommendations to the Secretary to further improve compliance with the EODB Law and other relevant statutory and regulatory requirements; and

25. Ensure to perform such other functions, duties, and responsibilities under EODB Law, its IRR, and other existing and future issuances by the ARTA, and other Regulatory/Oversight Agencies.
